These Terms of Service ("Terms") govern your access to and use of BIX - Brand Intelligence Experience (the "Service") operated by Signal X Studio ("we," "our," or "us").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

By creating an account or using the Service, you represent that:

  • You are at least 18 years old
  • You have the authority to enter into these Terms
  • Your use complies with all applicable laws and regulations

If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

BIX (Brand Intelligence Experience) is a domain-centric analytics platform that monitors brand perception across AI systems. The Service provides:

  • Domain visibility monitoring and citation tracking
  • Sentiment analysis across AI platforms
  • Pre-computed aggregated statistics and dashboards
  • Historical trend analysis and reporting
  • Category and industry benchmarking

We reserve the right to modify, suspend, or discontinue the Service at any time without notice.

3. User Accounts

3.1 Account Creation

To use certain features, you must create an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Promptly update any changes to your information
  • Accept responsibility for all activities under your account

3.2 Account Security

You are responsible for maintaining the confidentiality of your login credentials. Notify us immediately of any unauthorized access to your account.

3.3 API Keys

You may provide API keys for third-party services (such as Profound API). You are responsible for maintaining the security of these keys and any charges incurred through their use.

4. Acceptable Use

You agree not to:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights of others
  • Transmit malware, viruses, or harmful code
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Service
  • Use the Service for illegal, fraudulent, or harmful purposes
  • Monitor domains you do not own or have authorization to analyze
  • Exceed reasonable API usage limits
  • Share account access with unauthorized users

We may terminate or suspend your access for violations of these terms.

5. Intellectual Property

5.1 Our Intellectual Property

The Service, including its original content, features, and functionality, is owned by Signal X Studio and protected by copyright, trademark, and other intellectual property laws.

5.2 Your Content

You retain ownership of content you submit to the Service ("User Content"). By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display such content solely for the purpose of operating and providing the Service.

6. Third-Party Services

6.1 Third-Party Integrations

The Service integrates with the Profound API for domain analytics. Your use of such integrations is subject to those third parties' terms and policies.

6.2 Analytics Data

The Service aggregates and displays analytics from third-party sources. You understand that:

  • Analytics data may vary and change over time
  • BIQ scores and metrics are estimates based on available data
  • We do not control third-party data providers' algorithms or outputs

Data Disclaimer: Analytics data is provided for informational purposes only. We do not guarantee the accuracy, completeness, or reliability of third-party data. You are responsible for verifying any data before relying on it for business decisions.

7. Payment Terms

Certain features of the Service may require payment. If you subscribe to a paid plan:

  • You agree to pay all fees associated with your selected plan
  • Fees are billed in advance on a recurring basis
  • You authorize us to charge your payment method on file
  • Refunds are provided in accordance with our refund policy

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the practices described therein.

8.1 Data Security

  • API keys are encrypted before storage
  • Data is transmitted over encrypted connections (HTTPS/TLS)
  • Multi-tenant isolation is enforced via Row-Level Security
  • We implement industry-standard security practices

8.2 Data Ownership

You retain ownership of your data. We do not claim ownership of data you upload or generate through the Service.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

  • The Service will be uninterrupted or error-free
  • Defects will be corrected
  • The Service is free of viruses or harmful components
  • BIX scores or analysis will be accurate or produce desired results
  • Third-party data will remain consistent or available

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SIGNAL X STUDIO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

  • Your use or inability to use the Service
  • Any unauthorized access to your data
  • Inaccuracies in BIX scores or analysis
  • Business decisions made based on Service outputs
  • Changes to third-party data provider availability

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify, defend, and hold harmless Signal X Studio and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your User Content

12. Termination

12.1 Termination by You

You may terminate your account at any time by contacting us or using the account deletion feature if available.

12.2 Termination by Us

We may terminate or suspend your access immediately, without prior notice, for any reason, including breach of these Terms.

12.3 Effect of Termination

Upon termination:

  • Your right to use the Service ceases immediately
  • We may delete your account and data after a reasonable period
  • Provisions that by their nature should survive will survive termination

13. Dispute Resolution

13.1 Governing Law

These Terms are governed by the laws of the State of Illinois, United States, without regard to conflict of law principles.

13.2 Informal Resolution

Before filing a claim, you agree to attempt to resolve disputes informally by contacting us at hello@signalx.studio.

13.3 Jurisdiction

Any legal action arising from these Terms shall be brought exclusively in the state or federal courts located in Illinois, and you consent to the personal jurisdiction of such courts.

14. General Provisions

14.1 Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Signal X Studio regarding the Service.

14.2 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

14.3 Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in effect.

14.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.

14.5 Modifications

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms and updating the "Last Updated" date. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
